$299.99 Residential Alarm Promotion — Terms and Conditions

These promotional terms govern the $299.99 residential alarm promotion (the "Promotion") offered by Clarity. They supplement, and are incorporated into, Clarity's Standard Residential Security Agreement (the "Agreement") signed by each customer. Except where these terms specifically address the Promotion, the Agreement governs the relationship between Clarity and the customer, including its provisions on limitation of liability, warranties, arbitration, and allocation of risk.

1. What the Promotion includes

The $299.99 promotional price includes:

  • Two (2) door/window sensors

  • One (1) motion sensor

  • Standard professional installation of the above equipment

The $299.99 price is for the base equipment package and standard installation only. It does not include additional sensors, devices, or services, which are available for purchase separately. Applicable taxes are added to the promotional price.

2. Required monitoring and total cost

The Promotion requires the customer to enter into a new 60-month professional monitoring agreement at a starting rate of $59.99 per month.

The minimum monitoring commitment over the 60-month term is $3,599.40 (60 months × $59.99), in addition to the $299.99 equipment price and applicable taxes.

Rate adjustment. The $59.99 monthly rate is a starting rate and is subject to annual adjustment. As provided in the Agreement, after the first year of the term Clarity may increase charges by up to nine percent (9%) per year. As a result, the actual total paid over the 60-month term may be higher than the minimum stated above. For illustration, if the maximum 9% adjustment were applied in each year after the first, total monitoring over the 60-month term would be approximately $4,308. Adjustments are not guaranteed to occur and are capped as described in the Agreement.

3. Early termination

If the monitoring agreement is terminated before the end of the 60-month term, early termination charges apply as set out in the Agreement. As described there, these charges are assessed as liquidated damages equal to eighty percent (80%) of the monitoring charges remaining for the balance of the term, plus any unpaid installation charges and any other amounts already invoiced. Full details are in the Agreement.

4. Renewal

After the initial 60-month term, the monitoring agreement automatically renews on a month-to-month basis at the then-current rate, and continues until cancelled. To stop renewal, the customer must give Clarity notice at least 30 days before the end of the term, using any of the methods described in the Agreement. The Agreement contains the full automatic-renewal terms.

5. Eligibility

  • Available to new residential customers only.

  • Subject to credit approval.

  • Available within Clarity's service area.

  • May not be combined with any other offer, discount, or promotion.

  • Limited to one Promotion per household/premises.

6. Equipment and coverage limitations

The base equipment package provides limited coverage. It is designed to detect certain conditions at a limited number of points in the premises and is not intended to provide comprehensive protection. Additional sensors and devices are recommended for more complete coverage and are available for purchase.

No alarm system can prevent all loss, injury, or damage, or guarantee detection in every circumstance. Clarity is not an insurer. The customer's rights and remedies, and Clarity's limitations of liability, are governed by the Agreement.

7. Relationship to the Standard Residential Security Agreement

These promotional terms are part of, and are governed by, the Agreement. In the event of any conflict between these terms and the Agreement with respect to the specific Promotion pricing and inclusions described above, these terms control for those items only; the Agreement governs all other matters. Nothing in these terms modifies the Agreement's provisions on limitation of liability, warranties, indemnification, arbitration, or allocation of risk.

8. Changes to the Promotion

Clarity reserves the right to modify, suspend, or end the Promotion at any time without notice. Pricing, equipment, and availability are subject to change. The Promotion is valid only for agreements signed on or before. Customers who have already signed are governed by the terms in effect at the time of signing.
